Air America Radio, Gloria Wise Invesigation

COUGH IT UP, GUYS

Air America Finally Forced To Turn Over Charity $$$

Even as it fades into broadcast oblivion, Air America Radio still won't concede any ground on its sleazy charity funds raid. This is one stubborn operation, folks.

But it has been compelled to cough up the dough nonetheless, and the New York State Attorney General's office has now transferred the case to its criminal prosecutions bureau, the New York Times (!!) reports today.

Late Yesterday, the New York City Department Of Investigation finally broke its lengthy recent silence on the status of the Gloria Wise Boys & Girls Club scandal, where the liberal radio network received $875,000 in taxpayer funds that had been earmarked for the Bronx- based charity.

For many months, Air America attorney Bill Schaap has controlled an (IOLA) escrow account for the purpose of repaying this money, with the DOI now having ordered at least some, if not all, of this dirty dough returned. Liberal "investors" funded the kitty, generally in $50,000 contributions.

The company, meanwhile, continues to foolishly insist that a different corporation ran Air America during the time of the scandal, which is true only in a technical, but not in any moral, or ethical sense. Yes, some of those behind the network at the time have long since left the building, but many others are still in the mix, or have departed just recently.

But the continued denials may be an attempt to avoid further legal liability. And even for those who weren't involved in the initial swindle, the subsequent Enron- like cover- up was just as disgusting.

Because the exact details of these new developments vary somewhat, let's do a quick rundown:

From the New York Sun's David Lombino:

A Boys and Girls Club in the Bronx has received $250,000 from the leftleaning radio network Air America in the wake of a probe by the New York City Department of Investigation.

Last summer, as part of DOI's investigation into the Gloria Wise Boys & Girls Club regarding improper expenditures of city funds, the agency discovered that the club had transferred $875,000 to Air America in the period leading up to the network's launch in March 2004.

A co-founder of Air America, Evan Montvel Cohen, had simultaneously served as development director for the Gloria Wise Boys & Girls Club. Mr. Cohen later told The New York Sun that he arranged the transfer of $875,000 to the radio network from the club.

Ownership of Air America has since changed hands, and last September the current owner, Piquant LLC, deposited $875,000 into an attorney-controlled escrow account to be released to Gloria Wise when the DOI authorized payment.

Yesterday, the DOI announced that it had asked Air America to release the money. A statement from DOI said that $625,000 would be returned to a variety of city agencies after Gloria Wise was found to have misused the funds. The remaining $250,000 has been returned to Gloria Wise for its operating expenses.

Gloria Wise has been badly damaged by the scandal: It has lost its city funding and its affiliation with Boys & Girls Club of America.

The club's new chief executive, Fred Lewis, told the Associated Press that the investigation will likely lead to criminal charges.

From Sewell Chan at the New York Times (a publication that tried to ignore this story last year):

A Bronx charity will pay the city back $625,000 that had been intended for children and the elderly but was improperly lent to Air America Radio, a network known for its liberal programming and hosts like Al Franken.

The settlement, announced yesterday by the city’s Department of Investigation, is the latest but probably not the final chapter in an investigation that began last year.

The state attorney general’s office is continuing to look into the misuse of the funds, and the case has been transferred from its charities bureau to the criminal prosecutions bureau, two people close to the investigation said yesterday.

City investigators found that the charity, based in Co-op City and formerly known as the Gloria Wise Boys and Girls Club, lent $875,000 to Air America Radio. At the city’s request, the network put the money into an escrow account while the investigation continued.

Now, $625,000 will be returned to the city and $250,000 will be turned over to the charity for its operations. The $625,000 recouped by the city includes $250,000 from the Department of Youth and Community Development and the Department for the Aging that the charity misused from 2001 to 2004 and $375,000 in overpayments from the Department of Education to a nursery and kindergarten run by the charity from 1997 to 2006.

“This is a somewhat shocking case,” said the commissioner of investigation, Rose Gill Hearn, who described the circumstances as “clearly unusual.” She said the recovery of the money was significant because “most of the time, people spend it and it’s dissipated.”

Ms. Gill Hearn said that the investigation into the charity involved “a copious analysis and forensic audit of their books and records.” In some instances, officials at the charity fabricated invoices for consulting services that never existed.

Until last year, Gloria Wise and an affiliated charity, Pathways for Youth, relied on the city for nearly 80 percent of their budgets. The city no longer has contracts with Gloria Wise.

And from the AP's David Caruso:

NEW YORK -- A community center investigated after it gave $875,000 to the liberal radio network Air America has reached a financial settlement with the city over government funds mishandled by its former officers.

The city's Department of Investigation announced Wednesday that the Gloria Wise Community Center in the Bronx has repaid $625,000 it had received from city agencies for its youth programs and nursery school.

A majority of that money was a refund of overpayments the center received from the city's education department, but at least $250,000 were related to "improper expenditures," by executives, the Department of Investigation said.

Those expenses included pay bonuses and personal expenses by some Gloria Wise officials, said the department.

It declined to elaborate, citing an ongoing criminal probe by the New York Attorney General, but the center's newly installed chief executive, Fred Lewis, said some of the charity's money was used for home renovations and car payments.

Lewis said he expected the case to result in criminal charges, but not against any current administrators or staff.

The organization, which was stripped of its affiliation with the Boys & Girls Clubs of America last summer, has ousted its old board members and has a new personnel, he said.

Working with Michelle Malkin, your Radio Equalizer did a lengthy series of investigative reports on this matter, beginning in July, 2005. We established not only the fact that Air America Radio has existed largely as part of an ongoing shell game, but that Al Franken was well aware of the scandal, long before he claimed.

Rather than insist the kids get their money back, Al Franken pushed for an outrageous salary and benefits increase, including a successful demand that he be paid a full year's compensation up front.

Left-leaning bloggers and Air America hosts, meanwhile, have long tried to pretend this scandal didn't exist, even going as far as to attack us for "making up" the story. Others actually tried to blame it on a Republican plot, simply because Evan Cohen, a key player in this mess, once worked for the GOP governor of Guam. But he's as liberal as they come.

Network hosts, who thunder about the "Bush crime family" on a daily basis, have mostly avoided discussion of their own sleazy ca$h grab.

Meanwhile, via an internal source, it had come to our attention recently that some former and current Air America executives could face further questioning in the matter and were said to be very concerned about that possibility.

No matter how the company may try to spin this mess today, one thing is clear: it not only hasn't put the matter behind it, but the biggest fireworks are yet to come.

Rose petals were thrown at Woodward and Bernstein, and brickbats at Maloney. Guess it makes a difference which ideology the the bad guys are pushing.

Now where are the $11 billion missing Iraqi monies, you know the Saddam money we had control over???

In the world of a sociopathic Republican
a $875,000 scam, being paid back by A.A is earth shattering!!!!
but the $11 billion missin from Iraq

  • Al Franken mentioned something about a leak to the Radio Equalizer just a couple of minutes into his second hour today 9/28. I didn't catch exactly what he was saying, maybe you can catch it on replay.

  • The Strawman asks: "Ohhh boyy, so it appears they are giving the monery back, good for them, they should, but wehat does this haver to do with Franken."

Well, genius, here's what it has to do with Franken: Al Franken is one of the people to whom that AAR has had to cough up major dough on a quarterly basis in order to procure his 'services' for AAR.

The $875K embezzled from Gloria Wise was used for AAR operating expenses.

Of course, no one can tell exactly which money went where because AAR has been operated through shell corporations for its entire existence.

Hopefully the DOI can get a good forensic accountant in to do a nice little run-through of AAR's books, such as they are, to figure out who knew what and when.

  • Some of you guys on the right need to get a grip. You keep trying to WRITE history according to what you want it to be and the hell with the facts.

JD says because Al Franken expected to get paid for his work, so he some how had a hand in this. We sure he expected to get paid, how many FREE days have you given the company you work for?

Then he says the MONEY WAS EMBEZZLED.

The FACTS are listed below from The City of New York, Department of Investigation.

I assume that most of you are over 15 or 16 so you should be able to read and understand the TRUTH of this matter.

STATEMENT FROM DOI REGARDING SETTLEMENT WITH GLORIA WISE

ROSE GILL HEARN, Commissioner of the New York City Department of Investigation (DOI), announced today that the Bronx-based not-for-profit Gloria Wise Boys and Girls Club, Inc. has agreed to repay the City $625,000 in a settlement with DOI concerning City money that Gloria Wise executives misspent on themselves and other impermissible payees.

These funds compensate the City for $250,000 in improper expenditures by Gloria Wise between January 2001 and January 2004 from funds obtained from the City through contracts between Gloria Wise and the Department of Youth and Community Development (DYCD) and the Department for the Aging (DFTA); and $375,000 in overpayments by the Department of Education (DOE) to the Goose Bay Nursery and Kindergarten between 1997 and 2006.

During the course of a DOI investigation into improper expenditures at Gloria Wise, DOI discovered that the social services agency had loaned $875,000 to SCG and Radio Free America, which once owned Air America. At DOI’s request, Air America put the $875,000 into an escrow account and agreed in writing not to distribute the money until DOI authorized payment of the funds. DOI has directed Air America to release the funds and Air America has transferred $625,000 to the City and the remaining balance, $250,000, has been transferred to Gloria Wise for its operating expenses.

The City no longer has contracts with Gloria Wise. In June 2005, DOI shared its preliminary findings with DYCD, DOE, DFTA, and the New York City Housing Authority (NYCHA), and those City agencies terminated their funding to Gloria Wise, which included another Bronx-based not-for-profit Pathways for Youth, and declined to award them any new contracts or grants. Until that point, nearly 80% of Gloria Wise/Pathways funding came from the City.

DOI has shared its findings with a variety of government agencies, including the Office of the New York State Attorney General. DOI will publish its findings once the investigation is complete.

DOI Commissioner Rose Gill Hearn said, “I am pleased that DOI has been able to successfully recover this money for the City. DOI will continue to be vigilant in ensuring that not-for-profits that receive City funding properly allocate that funding for the people and services for which it was intended.”

DOI is one of the oldest law-enforcement agencies in the country. The agency investigates and refers for prosecution City employees and contractors engaged in corrupt or fraudulent activities or unethical conduct. Investigations may involve any agency, officer, elected official or employee of the City, as well as those who do business with or receive benefits from the City.

Get the worms out of the Big Apple.
To report someone ripping off the city, call DOI at (212) 825-5959.

By Blogger mick, at 29 September, 2006 01:12

  • I don't think that particular DOI statement takes away from the severity of what has occurred here.

Keep in mind that the DOI has been far more blunt in previous statements, particularly involving the IOLA escrow account. Air America's attorney controlled it. And if this hadn't become a major press issue, they would have been able to sweep it under the rug for good.

In addition, the fact that the state AG's office has transferred the case to its criminal division (from the charities division previously) tells the real story.

There's no way to spin this one based only on one carefully- worded DOI statement.

By Blogger Brian Maloney, at 29 September, 2006 01:38

  • J.D
shattered into tiny pieces by the facts. No money was "embezelled". Money was loaned and repaid, the money appears to never have even been spent by A.A. The issue was the "loaner" inproperly obtaning the money and using non-profit money for a for profit entity. And Franken?? Nothing to do with it, you grasped at straws trying to tie Franken into the money. Sad.
And Maloney, even more sociopathic accuses the DOI of being influenced by Air America's attorney and writing a soft summary of the events. Bottom line Wise may have broke the law not Air America. DOI went after Wise for improperly dstributing city money. Overall this whole exercise is one of crayyyyzeee right wingers being more concerned with anything to do with Liberals, instead of focusing how this sick, deviant administration has stolen $11 billion in Iraq monies. Standard party over country wack jobs. America authorized torture, syncopants attack Franken, GOP creates teror with a failed Iraqi war, cwayzzzeee conservatives cry about Clinton slapping around Wallace on Faux TV. Cons or at least blind party Bush hacks, will never acknowledge that Liberals have been right on EVERY SINGLE ISSUE regarding this administration, thus the endless attacks on the truth tellers.

  • While the drooling, senile, falafel toting demographic of Bill O'Reilly is obsessed with the missteps of a former executive of AAR, the violence in IRAQ worsens, the shoddy work of contractors is exposed, and the close relations of Jack Abramoff with the Bush Administration is documented.

  • The only thing that extricates American policy from Stalinist shool of thought as of yesterday, is the fact that we are not assinating Americans on the spot and selectivly starving whole populations. Yesterday was one of the darkest days in American history, and several Democrats in passive acquiesce went along with this bill in fear of being called "weak on terror". This is the current political climate, and A.M talk radio and the RNC are responsible for the death of American democracy.
Here in conservo-crazy land, Air America is more important. Yesterday will forever be a day of infamy for this country. The day Osama Bin Laden won, the day this country decided to turn the president into a unitary executive, who can interrupt the RULE of law the way he wants. The president can now decide what "rape" is by his defination in regards to interrogation, similiar to the way Clinton defined what "sex was" in regards to Monica. Bizzare, how conservatives flipped out over Clinton's defination of "Sex", but are stunningly silent over these new powers handed over to the president. Osama has indeed won, we just flushed American justice down the drain and flushed the rule of law down the drain in the name of 9-11.

  • "The only thing that extricates American policy from Stalinist shool of thought as of yesterday, is the fact that we are not assinating Americans on the spot and selectivly starving whole populations."

That, and that there is a free press, a free market, free opinion, freedom to ignore leftwing propaganda, political prisoners aren't summarily thrown in prison or executed for disagreeing with der leader, communism isn't the state religion or governing philosophy, gulags don't exist, we're not a hulk of poor starving masses scraping for scraps and grains on the floors, the CIA doesn't go around spying and inprisoning dissidents, there is freedom of choice, etc.

So in other words, we're perhaps the farthest thing from Stalinism the world has yet known.

Yesterday was one of the DARKEST DAYS IN THE HISTORY OF AMERICA, you are intellectualy incapable of understanding this, because you are a sycophant for the GOP. excuse me, that was then, this is now, Bush just forever changed these rights. Read what was passed yestrday. Defending the indefensible, "enemy combatant" is not defined, as only people captured on the BATTLE FIELD. I'm 100% correct. You defend a president which should be in the Hague , over 400 prisioners have been released, who were indeed torture. The law does indeed make citizens ENEMY COMBATANTS, judicial exprerts have already stated this. You are defending the indefensible. Legal scholars AGREE with ME. 'enemy combatants" defination is now BROADER, got it BROADER, it does not rule out US CITIZENS. Read a newspaper, (a one with small letters like the NY times) it is all over the papers already.
I'm 100% correct, Im going by what JUDICIAL SCHOLARS have STATED, not what Limbaugh is saying.

Can it be, I understand constitutional law, (since my girlfriend happens to be a lawyer) and you do not?? You accuse me of not knowing what I'm, talking about?? That is an absolute joke. You sound like a knuckle dragging ignoramace, you recited exactly what Limbaugh told you to say regarding this issue. I just sent you a link to a constitutional scholar's interpretation of this law. eEt me take a guess as to what your mendacicious response will be. It will go along the lines of "far left liberal wacko liberal lawyer". I suppose that constitution is a just a far left piece of paper, right? Now tell me how wrong I'm again. Tell me again how this law clearly defines that an "enemy combatant" is only a foreign terorist?? Tell me again, ohh please do.There is no need for the abeyance of habeas corpus, we did not do this during WW1, not during ww2, not during the cold war, not even as the British invaded the White Hiuse, in our natrion's infancy. Tell me again why we need to dismantle our justice system because of "the terrorists". Ohh please, tell me, how there is a clearly defined definition of "enemy combatant". I can hardly wait

  • You are absolutley pathetic Good. Lt. As predicted, constitutional scholars, who are experts in constitutional law, have been turned into "lib lib left wing lib lib"

You attenuate everything to liberal vs conservative. You have blatent antipathy to the constitution in that case. One can conclude that since anyone who is a constitutional scholar is "lib lib lib" as Lt. posted and the other sad hack posted as well, the constitution is a "liberal article". You both have animus feelings towards anyone who is capable of understanding this bill passed. You are inccapable (as evidenced by the pathetic response) from grasping the topics in hand. Face it you ar both partisan hacks, who take your undying loyalty to a political party over reality. I will stand by what the scholars are saying. Untill, you can reference a single constitutional scholar who says otherwise, I'm correct and you are just spinning for Bush. You can not distinguish reality from the encomium you show towards the concept of "Republican party". YOu still think this is a football game, not your own country. This bill equals an autocratic style government. I want a democracy, not an autocracy. The diffrence between you and I is simple, I'm capable of discerning the facts gathered, you just blindly cheerlead. If a Democrat dared to create a bill like this, I would be just as outraged, and so would you. In your warped world, it is all about who wrote the bill and their party affiliation, not the actual bill. Both of your taciturnic responses prove you both do not grasp the issue.

Take a seat loser, you have been dismissed. I outcalss you in depth, substance and style. Deal with it. Gd Lt. you are nothing but an ingenueous, uneducated failure at life.

  • I did not say in my statement that I agree with the bill. I said that the site you referenced was liberal. I believe that because of the liberal positions they support. Example: Reparations for African Americans, voting rights for convicted felonies in prison or on parole. I believe those are liberal issues. They support groups that try to win these cases not by following the constitution but by using Quote” innovative litigation”

    http://www.ccr-ny.org/v2/legal/justice/justice.asp?offset=0

So like I said Constitutional scholars my butt?
Now are you correct about Americains losing right because of this bill? If you havn't read the bill (address below). See if you understand it to the level of noing what it would do. For myself I read it and do not agree with what you said. No I am not some constitutional scholar so yes I could be wrong. If I am then I trust the supreme court to decide it is not constitioninal. I am not going to listen to a web site that DOES have a political aginda.

You can name call all you want that will show everyone how much class you have.

As for how successful I am. I have no need to explain to a guy with a 2bit talk show. But I do wish you luck in making it a success. I like people to hear your point of view.

  • "Take a seat loser, you have been dismissed. I outcalss you in depth, substance and style. Deal with it. Gd Lt. you are nothing but an ingenueous, uneducated failure at life."

Actually, since you can not produce a case or a name signifying your fears and claims after being given multiple promptings to do so, it is evident that you have no evidence of anything happening that you claim is happening.

Hence, you lose. Jackass. You are a personification of the reason that liberal talk radio is the failure that it is and always will be.

  • "The diffrence between you and I is simple, I'm capable of discerning the facts gathered, you just blindly cheerlead. "

You haven't presented a fact supporting your contention yet. This is how an educated person comes to conclusions - claims are to be backed up with facts and evidence, not cursing, namecalling and leftist rhetorical hate.

NAME A VICTIM. A CASE. A SMOKING GUN.

You can't, because there isn't one. Have a nice life in this fascist nation where you are free to criticize the government until you are apoplectic and in a coma. It is amusing to read your progressive hate speech, to say the least.

Also quite revealing of your psychosis if you really want to put a fine point on it.

  • Brian Maloney said: “There's no way to spin this one based only on one carefully- worded DOI statement.”

I didn’t answer sooner because when I first read your reply I started to laugh. I’ve been laughing for days.

Brian ONLY YOU could suggest that an OFFICIAL Government document from the Department that is CHARGED to Investigate this situation and RESOLVE it would create a “CAREFULLY-WORDED DOI STATEMENT”.

What part of “STATEMENT FROM DOI REGARDING SETTLEMENT WITH GLORIA WISE” don’t you understand?

I know your used to getting your facts from what’s her name. . . oh damn you know what’s her name. . . Mmmmmmmmm Mmmmmmmmm (close enough).

  • lt.
I showed you an analysis of this ruling which leaves the door open for erosion of civlil liberties. There have been cases of people being arrested based on what they looked at online already. Google it yourself. I showed you how this ruling is awful. Can you show me, how the link I sent you is wrong? I don't represent Liberal radio, I represent myself. Liberal radio is not a failure, as you can see if you had access to the ratings around America. Randi Rhodes scored a 9.0 in Florida last book, that is a 9.0, for 25-34, on the Limbaugh station in Palm Beach. There are plenty of other examples. Prove the analysis wrong, go ahead. I can't wait to see this.
And I can play the sick little pundit game as good as the next guy, only I use facts, and RNC hacks use rhetoric and slogans.
Enjoy the party of perversion, torture and sickness. A certain kind of person gravitates to this sickness, says something of you.
Folks, keep your children away from Wing nuts!!

  • Minister of Propaganda - congratulations, you are officially the stupidest leftard I have ever read in my life - maybe on the entire internet. But at least you chose an appropriate moniker and spelled "propaganda" right.

It seems kind of pointless to respond to someone so utterly vapid. You're the toy poodle yap-yap-yapping at all the German Shepherds from behind the security of a 6-foot high fence. "Prove there haven't been civil rights violations! Prove it! Arf! Arf!"

Whatever. Prove Al Franken doesn't kill puppies. Prove Michael Moron isn't your gay lover.

And in the meantime, your Muslim overlords demand that you prostrate yourself and grovel before them, beeoch.

  • The NY DOI's Exhibits have images of two 6 figure checks that were supposedly deposited in escrow with Air America's lawyer.

    The checks are not dated.

That could mean they were never actually deposited. And that the money was never there.

    We'll see what happens.

  • Unfortunately, the actual bill refutes the "could apply to US Citizens" absurdity and also requires a tribunal - not the president - to determine status as lawful (would have Geneva protections) or unlawful:

    Sec. 948b. Military commissions generally

`(a) Purpose- This chapter establishes procedures governing the use of military commissions to try alien unlawful enemy combatants engaged in hostilities against the United States for violations of the law of war and other offenses triable by military commission.
Sec. 948c. Persons subject to military commissions

`Any alien unlawful enemy combatant is subject to trial by military commission under this chapter.
`Sec. 948d. Jurisdiction of military commissions

`(a) Jurisdiction- A military commission under this chapter shall have jurisdiction to try any offense made punishable by this chapter or the law of war when committed by an alien unlawful enemy combatant before, on, or after September 11, 2001.
