Ahead of a widely-expected crackdown on free speech and political dissent by the incoming Obama administration, our Dear Leader has appointed a new FCC transition czar to oversee the process.
Henry Rivera, a longtime radical leftist, lawyer and former FCC commissioner, is expected to lead the push to dismantle commercial talk radio that is favored by a number of Democratic Party senators. Rivera will play a pivotal role in preventing critics from having a public voice during Obama's tenure in office.
Rivera, who resigned from the FCC nearly a quarter-century ago during the Reagan years, believes in a doctrine of "communications policy as a civil rights issue".
His exit during the Reagan Administration paved the way for the Fairness Doctrine's repeal when the late president appointed Patricia Diaz Dennis in 1986 to fill out the rest of Rivera's term. Had this not occurred, talk radio as we know it today would not exist.
That gives Rivera's new task a great deal of personal urgency: it's a late-career, second chance opportunity to shut down opposition voices that have been allowed to flourish since his depature from the commission.
In particular, Rivera is known for his push for more minority broadcasting ownership, but this issue has largely been rendered obsolete as former commercial broadcasting empires teeter on the brink of bankruptcy.
Rivera's first opportunity to eliminate commercial talk radio will occur in June 2009, as the term of Republican Robert McDowell expires and he can be replaced with a pro-Fairness Doctrine Democrat. That will give the commission a three-vote Democratic majority, though the final two seats must remain in Republican hands.
If they can strong-arm one of the three Republicans into leaving early, this can be implemented even sooner.
One issue facing Rivera and Obama's new commissioner is how the policy will be carried out. According to data from the 1970s, when the old doctrine regulated the content of speech on the radio, the FCC was forced to utilize a great deal of its resources sifting through tens of thousands of "unfairness" complaints. The FCC's staff might have to be increased substantially to accommodate listeners looking to censor radio programming in their area.
Meanwhile, Air America Radio apparently believes liberal talk radio will benefit from the Fairness Doctrine's implementation! In an interview with a broadcast trade publication, Air America CEO Bennett Zier seems to believe that conservative stations would be forced to carry libtalk programming in order to comply with the law (but wouldn't libtalk stations also be required to run conservatives?):
But this is delusional, as Air America's wildly unpopular talk programming will merely speed the demise of commercial radio if forced upon the industry's most-successful stations, which happen to be conservative talkers.
That could move the rest of the medium to the Internet and satellite radio, where Air America is already heard. The result would be a wipeout of a number of liberal radio executives who supported Obama.
Successful attempts by Democrats to suppress free speech will probably be cloaked, using different terminology and phony justifications. Don't be fooled: the only reason for this crusade is to wipe out every trace of political dissent.
UPDATE: Rivera was subsequently moved out of this official role due to an undisclosed conflict of interest. We'll be watching to see if he in fact takes an FCC-related position down the road.

BENNETT ZIER: If there’s a Fairness Doctrine, one would say that would be a good thing for left-of-center talk. But I think if Air America puts forth relevant, entertaining, provocative content, it’ll be a balance. People will be interested in what we want to do. We believe that we need to control our own destiny, and we’re going to do that by giving the listeners, the viewers, and the readers what they want in a lot of different technologies.

I agree that HD is the response to the Fairness Doctrine. As I have written here before, AAR already claims as one of its "stations" an FMer that carries AAR only on an HD subcarrier.
Remember, those NOAA weather stations with their sub-telephone quality mechanical voices broadcast on FM. If demanded by the Fairness Doctrine, I foresee a two-hour libtalk show repeated continuously at very low fidelity on an FM HD subcarrier to balance out an owner group's carriage of conservative talk on their blowtorch AM in the same town: End of problem.

This probably won't pass the courts because the courts will claim there are more then enough radio stations on the air fro wide range of thought. I know liberals don't want talk radio because they are anti-free speech and have to silence the opposition because they can't debate in the arena of ideals.

Those voices include Laura Ingraham, Rush Limbaugh, Sean Hannity, Michael Medved, Roger Hedgecock, Hugh Hewitt, Kevin James and Mark Levin (to name a few). So what? The federal government is gonna slap ham and cheese between these staples? Keith Obermann? Hah! Stand back and watch the ratings go off the cliff during THAT time slot, just as Err America was never able to develop an audience. So much for truth, morals, and integrity. I've heard enough about who is to blame for the problems that this country has to make me vomit!! Anyone who claims he cares for their fellow man and yet is for the killing of humans yet to be born, is BS'ing you! I find it quite ironic or overly rediculous that people who have already been born are for abortion!! How did they get here? They came the same way these innocent babies that are murdered came!! Its not just the US market that went down (1000 points in 2 days after Obama election) but the rest of the world as well. Most people in business know his viewpoints tendered so far have projected him to be pro-business unfriendly (if his tax plan is to give more to the poor guy that means he has to take more from the bigger guys - and thats not business savy especially with industries going into recession gear. It'll scare the sh** out of new entrant potential entreprenuers)
China has indirectly hinted at preference for Obama because it feels it'll be able to wrestle more concessions in bi-lateral negotiations on a range of issues to their advantage than with McCain (he appears hard fisted). Iran's president has even sent a cynical congratulations message to Obama - more in jeer than cheer (I don't think one would have been sent if McCain had been elected). These are people, especially world political and economic leaders - those who do not have to cast their tickets on US balloting day (and so their assessment of Obama are more objective in their assessment of him as they are not subject to American media's obsession in playing up Obama's theatrical display and oratorical skills, these are the people who look at the things he had said at different times and at different places - and they know the man for what he is nothing, but a crowd pleaser. He's got superb oratorical, theatrical (watch his expression when he talks, he's definitely undergone character personification training sessions -sounds like JFK to you?) and mesmerising (hynoptical) skills. Full of rhetoric. Hitler, Mussolini, and even Iranian President Ahmadinejad to a certain extent ,were all like that ! And where did they lead their country to?
So the next 4 years will be turbulent for America under such a leader - MORE FUMBLES (inappropriate and ineffective economic policies being introduced because he wanted changes), MORE RUMBLES (of war. Israel will probably go it alone to do pre-emptive strike at Iranian nuclear facilities without consultation with US, escalation of North Korean nuclear belligerence, and maybe even acquisition of a dirty bomb by terrorists), MORE TUMBLES (the stock markets are going to continues freefalling perhaps even cascading at regular intervals), and finally MORE GRUMBLES (from irate voters who had put their faith in him. especially those who have given him carte blanche)

The airwaves are one of the last the public domain ... Those radio waves travel through us and that's partly why. It's about F@@king time there was some FAIRNESS (doctrine).
For over a decade I have only 2 choices of political talk to listen to;
1) Right Wing Propaganda (times 5)
&
2) OFF !!!!!
IF the greedy conservative corporate media just gave me ONE LIBERAL channel or a few stinkin shows (that I didn't have to pay for like yous) I wouldn't complain.

Give talkradio credit, it saved AM radio when it needed to be saved. Also it created economic sucess for the USA and created needed "balance" against the MSM which has become too liberal biased. If an Obama White tries to have talkradio shut down, it will create a justified angry backlash. Plus a new Fairness Doctrine would not survive a major court challenge and the growth of high tech in the areas of satilite, internet radio, and podcasting.

Hitler Becomes Dictator
After the elections of March 5, 1933, the Nazis began a systematic takeover of the state governments throughout Germany, ending a centuries old tradition of local political independence. Armed SA and SS thugs barged into local government offices using the state of emergency decree as a pretext to throw out legitimate office holders and replace them with Nazi Reich commissioners.
Political enemies were arrested by the thousands and put in hastily constructed holding pens. Old army barracks and abandoned factories were used as prisons. Once inside, prisoners were subjected to military style drills and harsh discipline. They were often beaten and sometimes even tortured to death. This was the very beginning of the Nazi concentration camp system.
At this time, these early concentration camps were loosely organized under the control of the SA and the rival SS. Many were little more than barbed wire stockades know as 'wild' concentration camps, set up by local Gauleiters and SA leaders.
For Adolf Hitler, the goal of a legally established dictatorship was now within reach. On March 15, 1933, a cabinet meeting was held during which Hitler and Göring discussed how to obstruct what was left of the democratic process to get an Enabling Act passed by the Reichstag. This law would hand over the constitutional functions of the Reichstag to Hitler, including the power to make laws, control the budget and approve treaties with foreign governments.
The emergency decree signed by Hindenburg on February 28, after the Reichstag fire, made it easy for them to interfere with non-Nazi elected representatives of the people by simply arresting them.
As Hitler plotted to bring democracy to an end in Germany, Propaganda Minister Joseph Goebbels put together a brilliant public relations display at the official opening of the newly elected Reichstag.
On March 21, in the Garrison Church at Potsdam, the burial place of Frederick the Great, an elaborate ceremony took place designed to ease public concern over Hitler and his gangster-like new regime.
It was attended by President Hindenburg, foreign diplomats, the General Staff and all the old guard going back to the days of the Kaiser. Dressed in their handsome uniforms sprinkled with medals, they watched a most reverent Adolf Hitler give a speech paying respect to Hindenburg and celebrating the union of old Prussian military traditions and the new Nazi Reich. As a symbol of this, the old Imperial flags would soon add swastikas.
Finishing his speech, Hitler walked over to Hindenburg and respectfully bowed before him while taking hold of the old man's hand. The scene was recorded on film and by press photographers from around the world. This was precisely the impression Hitler and Goebbels wanted to give to the world, all the while plotting to toss aside Hindenburg and the elected Reichstag.
Later that same day, Hindenburg signed two decrees put before him by Hitler. The first offered full pardons to all Nazis currently in prison. The prison doors sprang open and out came an assortment of Nazi thugs and murderers.
The second decree signed by the befuddled old man allowed for the arrest of anyone suspected of maliciously criticizing the government and the Nazi party.
A third decree signed only by Hitler and Papen allowed for the establishment of special courts to try political offenders. These courts were conducted in the military style of a court-martial without a jury and usually with no counsel for the defense.
On March 23, the newly elected Reichstag met in the Kroll Opera House in Berlin to consider passing Hitler's Enabling Act. It was officially called the "Law for Removing the Distress of the People and the Reich." If passed, it would in effect vote democracy out of existence in Germany and establish the legal dictatorship of Adolf Hitler.
Brown-shirted Nazi storm troopers swarmed over the fancy old building in a show of force and as a visible threat. They stood outside, in the hallways and even lined the aisles inside, glaring ominously at anyone who might oppose Hitler's will.
Before the vote, Hitler made a speech in which he pledged to use restraint.
"The government will make use of these powers only insofar as they are essential for carrying out vitally necessary measures...The number of cases in which an internal necessity exists for having recourse to such a law is in itself a limited one," Hitler told the Reichstag.
He also promised an end to unemployment and pledged to promote peace with France, Great Britain and the Soviet Union. But in order to do all this, Hitler said, he first needed the Enabling Act. A two-thirds majority was needed, since the law would actually alter the constitution. Hitler needed 31 non-Nazi votes to pass it. He got those votes from the Catholic Center Party after making a false promise to restore some basic rights already taken away by decree.
Meanwhile, Nazi storm troopers chanted outside: "Full powers - or else! We want the bill - or fire and murder!!"
But one man arose amid the overwhelming might. Otto Wells, leader of the Social Democrats stood up and spoke quietly to Hitler.
"We German Social Democrats pledge ourselves solemnly in this historic hour to the principles of humanity and justice, of freedom and socialism. No enabling act can give you power to destroy ideas which are eternal and indestructible."
Hitler was enraged and jumped up to respond.
"You are no longer needed! - The star of Germany will rise and yours will sink! Your death knell has sounded!"
The vote was taken - 441 for, and only 84, the Social Democrats, against. The Nazis leapt to their feet clapping, stamping and shouting, then broke into the Nazi anthem, the Hörst Wessel song.
Democracy was ended. They had brought down the German Democratic Republic legally. From this day onward, the Reichstag would be just a sounding board, a cheering section for Hitler's pronouncements.
Interestingly, the Nazi party was now flooded with applications for membership. These latecomers were cynically labeled by old time Nazis as 'March Violets.' In May, the Nazi Party froze membership. Many of those kept out applied to the SA and the SS which were still accepting. However, in early 1934, Heinrich Himmler would throw out 50,000 of those 'March Violets' from the SS.
The Nazi Gleichschaltung now began, a massive coordination of all aspects of life under the swastika and the absolute leadership of Adolf Hitler.
Under Hitler, the State, not the individual, was supreme.
From the moment of birth one existed to serve the State and obey the dictates of the Führer. Those who disagreed were disposed of.
Many agreed. Bureaucrats, industrialists, even intellectual and literary figures, including Gerhart Hauptmann, world renowned dramatist, were coming out in open support of Hitler.
Many disagreed and left the country. A flood of the finest minds, including over two thousand writers, scientists, and people in the arts poured out of Germany and enriched other lands, mostly the United States. Among them - writer Thomas Mann, director Fritz Lang, actress Marlene Dietrich, architect Walter Gropius, musicians Otto Klemperer, Kurt Weill, Richard Tauber, psychologist Sigmund Freud, and Albert Einstein, who was visiting California when Hitler came to power and never returned to Germany.
In Germany, there were now constant Nazi rallies, parades, marches and meetings amid the relentless propaganda of Goebbels and the omnipresent swastika. For those who remained there was an odd mixture of fear and optimism in the air.
Now, for the first time as dictator, Adolf Hitler turned his attention to the driving force which had propelled him into politics in the first place

To everyone expressing the desire to see the "Fairness" Doctrine implemented, try thinking about it from the other side. You're advocating the government being able to dictate what a private company can do with its assets. It is literally the same principle as the government dictating that, while driving, you must make a left turn before stopping for every right turn you make, regardless of the difficulty or impossibility this creates in reaching your destination.

From everything I have read on here, the only thing I have to say is so much for Democrats believing in the First Amendment. So you can suppress Conservatives on campus from speaking and now you want to silence us on radio even though we have no desire to silince yor side. You have CNN, NBC, CBS, ABC, MSNBC, NY Times, LA Times, DC Compost, etc. and we say nothing besides they are baised beyond beleif. But your side is so filled with hate and rage, giving the other side a voice is just out of the question. I beleive Stalin did just this during his reign? This is too funny but as long as the Left gets enough people to threaten Kennedy with death over this, even he will vote against this in the supreme court like he did on the 2nd Amendment case in DC. That too will be under assault under this Admin. My question is after he is sworn in, will someone immediately call for article of impeachment because he will have sworn to uphold a document that he has publicly denouced as too restrictive to governmental expansion of power?

The Worldwide DEBT is the problem.
The best solution for the present economic crisis would be a REBOOT or restart of the entire debt system for the ENTIRE WORLD.
1. A data base listing ALL DEBT, government, business and personal needs to be created. The list would need to list the debt and debt holder with a bank that could make an accounting of the debt. Included would be all national debt of all nations, all mortgages car notes and credit cards for individuals. All outstanding bond and other debt for corporations, The idea is to list ALL DEBT of any kind owed.
2 . Every government on the planet would need to call a special session of it’s legislature.
Using the same authority that governments have to use or create FIAT CURRENCY the legislatures and Central Banks need to authorize the creation of ACCOUNT CREDIT in an amount equal to all the listed debts in the world.
3. The Various governments and Central Banking Systems then need to make an accounting change equal to the debt in the form of an ACCOUNT CREDIT or CREDIT zeroing out ALL THE DEBT in the entire world, and crediting all debt-holders in the world.
The following day the economy of the entire world would restart and the Stock Markets of the world would react to the new renewed capital in the banking systems, the Capital now available to restart all business and the disposable income to the individual people would restart and grow the retail sectors and the manufacturing sectors of the entire world.

The shows that survive on the radio are determined by market forces.These are determined by listeners supporting advertisers of these shows.No ones stopping liberal shows on radio.If people wanted it you would have plenty of it to listen to.
Government tampering with this requiring certain content outside of what the market desires sounds unconstitutional to me.It also sounds economically detrimental. What i don't understand is who's the government to decide what is a balance of opinions anyway.Even talk radio types don't see eye to eye with each other on many issues.And to be fair,where would this interference very well stop?There are an infinite number of views on a given topic.Couldn't anyone feeling their opinion wasn't represented write a letter of complaint demanding to be heard?To be fair,wouldn't the FCC be required to oblige them?
This isn't about fairness.It's about censorship by requiring air time to be filled with content as determined by a governmental agency.That market forces prove it's not economically viable doesn't seem to matter.Move over for Big Brother...

The most honorable thing that could happen to America if the likes of Rush Limbaugh, Sean Hannity and Bill O'Reilly just left this nation on their own. It should not be necessary to take the right of 'talk radio' away, just to relieve the world of American Terrorists who are instilling deceit and hatred in the minds of Americans too mentally unstable to realize that it is for entertainment only. These poor followers of Rush, Sean and Bill want to believe what they are spewing is true, dividing this nation in a time when Americans need to come together and bring our America back to superiority. Without FOXNEWS, McCain may have had a chance at Victory. Rush Limbaugh was directly responsible for many Republicans voting opposite of their registered party because NO ONE wanted to be grouped with such pettiness and hate. As for O'Reilly, the man is just over-the-edge of reality and brinking on self-destruction. He was questioning his ratings without realizing that we were all changing the station to get away from him..........they need to just disappear.
